(hereinafter, "NIExpress" or "the Controller").
2. Personal data we process
To provide our NIE (Foreigner Identity Number) management service, we collect the following categories of personal data, either through the website's contact form or later by email during the procedure:
- Full name
- Passport number
- Date of birth
- Nationality
- Email address
- Full postal address
- Phone number
- Expected date of relocation to Spain (if you do not yet live there)
We do not request or process special categories of data (health, religion, ethnic origin, etc.), unless voluntarily provided by the user on their own initiative, in which case it will be deleted if not necessary for the service.
3. Purpose of processing
Your data is processed to:
- Handle your information request and initial contact.
- Provide the NIE management service: booking the official appointment ("cita previa"), completing the EX-15 form, paying the Form 790 fee, and submitting the documentation to the National Police / Immigration Office.
- Communicate with you during the process (confirmations, requests for additional documents, appointment details).
- Comply with legal and tax obligations arising from the provision of the service.
We do not use your data to build automated profiles or for advertising purposes unrelated to the contracted service.
4. Legal basis for processing
Processing is based on:
- Performance of a contract or pre-contractual relationship (Art. 6.1.b GDPR): the NIE management service you request.
- Compliance with legal obligations (Art. 6.1.c GDPR) regarding tax and document retention.
Providing the data required to process the NIE is necessary to provide the service. Declining to provide it means we will be unable to process your request.
5. Recipients and data sharing
Your data may be shared with:
- The National Police / Immigration Office and other competent Spanish public authorities, strictly to the extent necessary to process your NIE on your behalf, in compliance with immigration regulations.
- Stripe, the payment gateway through which you pay for the service, which processes the data needed to take the payment. NIExpress does not store your card details.
- Vercel Inc. (USA), which hosts this website and provides the performance analytics tools (Vercel Analytics and Speed Insights), which do not use cookies or collect personally identifiable data.
- PostHog Inc., the usage analytics tool for this website, with data hosted in the European Union. It receives the pages visited and the buttons clicked, without cookies, without storing your IP address and without the data of your request or your case.
We do not share data with third parties for commercial or advertising purposes, nor make any other disclosures beyond those indicated.
6. International transfers
Vercel Inc. is based in the United States. Any international transfer of data to this provider is carried out under the safeguards set out in Chapter V of the GDPR, in particular through its adherence to the EU-U.S. Data Privacy Framework (DPF) and/or the inclusion of the European Commission's Standard Contractual Clauses in its data processing agreement. You may request further information on these safeguards by writing to info@niexpress.es.
7. Retention period
Data will be kept for as long as necessary to provide the requested service and, once completed, for the statutory limitation periods applicable (generally 5 years for tax and liability purposes, without prejudice to longer periods required by applicable law). Data from contact forms that do not result in a formalized service will be kept for a maximum of 12 months from the last contact, after which it will be deleted or anonymized.
8. Your rights
You may exercise, at any time, your rights to:
- Access your personal data.
- Rectify inaccurate data.
- Erasure ("right to be forgotten") when no longer necessary.
- Object to processing.
- Restrict processing.
- Data portability.
To do so, you can write to info@niexpress.es, specifying the right you wish to exercise and attaching a copy of an identity document. You also have the right to lodge a complaint with the Spanish Data Protection Agency (AEPD) at www.aepd.es if you believe your data has been processed unlawfully.
9. Source of the data
The data processed comes directly from the data subject, provided through the web form or through email communications exchanged during the provision of the service.
10. Data security
NIExpress applies appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including the use of encrypted connections (HTTPS/TLS) and restricted access to information, limited to those strictly necessary to provide the service.
11. Minors
The services offered are aimed at adults. If the NIE procedure concerns a minor, the data must be provided by their parent or legal guardian, who will act on the minor's behalf and confirms having the legal capacity to do so.
12. Cookie policy
This website does not use first-party or third-party cookies for tracking, advertising, or profiling purposes, and therefore does not require a cookie consent banner.
We use Vercel Analytics and Vercel Speed Insights, performance analytics tools that do not use cookies or store personal identifiers on your device; they only generate aggregated, anonymous statistics about the website's usage and performance.
To learn which pages and buttons are used we use PostHog, configured to store nothing on your device: no cookies, no local storage and no persistent identifiers. Each visit is measured separately and without your IP address.
If any non-essential cookie is introduced in the future (e.g., advanced analytics or advertising), we will request your prior consent through a cookie settings panel and update this policy accordingly.
13. Changes to this policy
This privacy policy may be updated to reflect legislative changes or changes to the services offered. Any relevant change will be published on this same page, indicating the date of the last update.
14. Contact
For any questions regarding this privacy policy or the processing of your personal data, you can contact us at info@niexpress.es.
